Terms of Service
Effective: July 15, 2026
These Terms govern your use of bodholdtspeedtesting.com and the Bodholdt Speed Testing mobile app (together, the “Service”). By registering or running a speed test, you agree to them. If you do not agree, please do not use the Service.
1. Who we are
The Service is operated by Bodholdt Speed Testing (“Bodholdt,” “we,” “us”). For anything in these Terms you can reach us at [email protected].
2. Eligibility
You must be at least 16 years old to create an account. By signing up, you confirm that you meet the age requirement and that you are legally allowed to enter into these Terms in your jurisdiction.
3. Your account
- You are responsible for keeping your login credentials confidential and for every action taken under your account.
- You agree to provide accurate information at registration and to keep it current.
- One person, one account. Automated account creation is not permitted.
- Tell us immediately at [email protected] if you suspect unauthorised access.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, including defamation, harassment, or infringement of anyone else's rights.
- Attempt to disrupt or overload the speed-test server, probe it for vulnerabilities, or bypass any rate limits.
- Reverse engineer, decompile, or repackage the mobile app, except to the extent that applicable law expressly permits.
- Submit falsified or manipulated speed data in an attempt to skew carrier rankings, leaderboards, or coverage maps.
- Scrape, copy, or redistribute public tests posted by other users in bulk without our written permission.
- Use the Service to transmit malware, spam, or unsolicited messages.
We may suspend or terminate accounts that violate these rules.
5. User content
- You keep ownership of anything you submit — speed tests, profile details, tower notes and photos, bug reports, and support messages.
- By marking a test or profile as public, you grant Bodholdt a worldwide, royalty-free licence to display, reproduce, and distribute that content as part of the Service (on leaderboards, maps, carrier reports, public profile pages, and related features). Tower submissions are covered by the more specific licence below.
- Aggregate, de-identified statistics derived from public tests may be published and shared with carriers, researchers, and the general public. Aggregate data cannot be traced back to your account.
- Private tests are not published or shown to other users. The processors named in our Privacy Policy may still handle them only as needed to operate the Service.
- You are responsible for making sure your public content does not violate the rights of others and complies with Section 4.
Tower and location photo submissions
The Service lets you contribute cell-tower locations, notes, and optional photos to the community coverage map. Because these become part of a public dataset, additional terms apply:
- Licence. By submitting a tower photo or note, you grant Bodholdt a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to host, store, reproduce, modify (including to resize the image and to blur faces, license plates, and other identifying details), publish, publicly display, and distribute it as part of the Service and its promotion.
- Your warranties. You represent and warrant that: (a) you took the photo yourself, or have all rights necessary to submit it; (b) it does not infringe anyone's intellectual-property, privacy, or publicity rights; (c) you took it from a place you were lawfully permitted to be, and did not trespass, climb any structure, or fly a drone unlawfully to obtain it; and (d) its primary subject is infrastructure — not an identifiable person — and it does not depict the interior of a private residence.
- Prohibited content. Do not submit photos whose subject is a person or a readable license plate, photos showing the inside of a private home, or any content that is unlawful, infringing, or defamatory.
- Review and blurring. Submitted photos are processed to remove embedded location metadata and to automatically blur detected faces, and are held privately until a human reviewer approves them. We may decline to publish, or later remove, any submission at our discretion. Approved submissions can be reported for removal by anyone — see the “Copyright complaints” section below and our Privacy Policy.
- Safety. Never trespass, climb, or put yourself in danger to capture a photo. Photograph towers only from places you are lawfully allowed to be.
6. Speed measurements
Our engine measures throughput between your device and our server under real-world network conditions. We are proud of the accuracy of our methodology, but network performance is inherently variable. Results depend on signal strength, server load, your device, concurrent traffic on your connection, and many other factors. We therefore provide measurements:
- “As-is” with no warranty that a given result is representative of your connection at any other time or place.
- For informational and community purposes only. Do not rely on any single result for purchasing, contractual, or legal decisions without independent verification.
We make reasonable efforts to disclose our methodology and to keep it transparent.
7. Service availability
We operate the Service on a best-effort basis. Servers can go down, test files can be unavailable, and features can change without notice. We do not promise uninterrupted or error-free operation.
8. Intellectual property
The Service, including its source code, design, logo, and content we author, is owned by Bodholdt and protected by copyright, trademark, and other laws. These Terms do not grant you any rights to Bodholdt trademarks or branding.
“Bodholdt Speed Testing” is a trademark of Kyle Bodholdt. The “SpeedTest” (one word, camel case) mark is not ours; we always refer to the generic act as “speed test” (two words).
Wireless carrier names and marks (for example, the names of mobile network operators shown in our coverage data, carrier comparisons, and rankings) are the trademarks of their respective owners. Bodholdt Speed Testing is an independent service and is not affiliated with, endorsed by, or sponsored by any wireless carrier. We reference carrier names only for identification and factual comparison of real, user-submitted measurement data. Nothing in the Service implies any partnership, certification, or approval by any carrier.
Copyright complaints (DMCA)
We respect intellectual-property rights and respond to valid notices under the U.S. Digital Millennium Copyright Act (DMCA). If you believe content on the Service infringes your copyright, send a notice to our designated agent:

Your notice must include: identification of the copyrighted work; identification of the allegedly infringing material and where it appears on the Service; your contact information; a statement that you have a good-faith belief the use is not authorised by the owner, its agent, or the law; a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act on the owner's behalf; and your physical or electronic signature. We will remove or disable access to material that is the subject of a valid notice, notify the affected user, and accept counter-notices. We terminate the accounts of repeat infringers.
9. Third-party services
The Service relies on third-party providers for speed-test delivery, maps and geocoding, optional push notifications, email, and opt-in diagnostics. Every current processor and its role is listed in our Privacy Policy, together with links to the relevant privacy policies.
10. Termination
- You may close your account at any time through the app (Settings → Danger Zone) or by emailing [email protected].
- We may suspend or terminate your access if you materially violate these Terms, if required by law, or if continued operation would create risk to other users.
- Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (for example, Sections 5, 8, 11, 12, 13) will continue to apply.
11. Disclaimers
The Service is provided on an “as-is” and “as-available” basis. To the fullest extent permitted by law, Bodholdt disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of data. We do not warrant that the Service will be uninterrupted, secure, or error-free.
12. Limitation of liability
To the fullest extent permitted by law, Bodholdt, its officers, agents, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Service. Our total aggregate liability for any claim arising out of these Terms is capped at the greater of one hundred US dollars (US$100) or the amount you have paid us in the twelve months before the claim arose.
13. Indemnification
You agree to indemnify and hold Bodholdt harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of the rights of a third party.
14. Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to the Service will be brought exclusively in the state or federal courts located in Placer County, California, and you consent to personal jurisdiction there.
Nothing in this section limits your statutory consumer rights in your country of residence.
15. Changes to these Terms
We may update these Terms to reflect changes in the Service or in law. For material changes, we will announce the update in-app and by email at least 14 days in advance. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
16. Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Bodholdt regarding the Service and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions remain in full force.
